1. AI Services and Disclaimer

You acknowledge that the Services involve the use of Artificial Intelligence (AI) technologies.

  • Accuracy: AI systems are probabilistic and may produce non-deterministic, inaccurate, or biased outputs ("hallucinations"). Rajat AI does not guarantee the accuracy, reliability, or completeness of any AI-generated content.
  • Liability: You are responsible for verifying all AI-generated outputs before using them in your business. Rajat AI shall not be liable for any decisions made or actions taken based on AI outputs. Please refer to our Disclaimer for full details on information accuracy and liability limitations.

2. Intellectual Property

Unless otherwise agreed in writing:

  • Pre-existing IP: All pre-existing intellectual property, tools, frameworks, and code libraries (including "Rajat AI" proprietary prompt engineering techniques) owned by Rajat AI remain my exclusive property.
  • Client Input: You retain all rights to the data and materials you provide to me.
  • AI Outputs: Upon full payment, you own the specific deliverables (code, configured agents, workflows) created for you. However, you acknowledge that pure AI-generated content may not be copyrightable under current laws.

3. User Responsibilities

You agree to use my services and website for lawful purposes only. You are responsible for ensuring that any data provided does not violate third-party rights.

4. Payment and Refund Policy

Payment terms for services will be outlined in your specific project proposal or invoice. Unless explicitly stated otherwise, all fees are non-refundable once services have been rendered.

5. Limitation of Liability

To the fullest extent permitted by law, Rajat AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption. My total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

6. No Guarantees

While I strive to deliver high-quality solutions, the nature of AI development involves inherent uncertainties. I do not guarantee specific business outcomes unless explicitly agreed upon.

7. Third-Party Analytics

We use third-party analytics tools (Google Analytics, Microsoft Clarity) to understand website usage. These tools are only activated upon your explicit consent via our cookie banner. By accepting cookies, you agree to the collection of anonymized usage data. You can change or withdraw that consent at any time using the Cookie Preferences link in the footer of every page, and we keep a record of each decision. 8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India.

9. Personal Data and the DPDP Act

Because these Terms are governed by Indian law, any personal data you give us through this website is handled under India's Digital Personal Data Protection Act, 2023 and the rules made under it. In the language of that Act we are the Data Fiduciary and you are the Data Principal.

What we collect, why, how long we keep it, and how to exercise your rights under the Act (access, correction, erasure, withdrawal of consent, and grievance redressal) are set out in full in our Privacy Policy, which forms part of these Terms. Where these Terms and the Privacy Policy differ on the handling of personal data, the Privacy Policy governs.

Nothing in these Terms limits any right the Act gives you, and nothing here should be read as a claim of certification or audit under it.

10. Changes to Terms

I reserve the right to modify these Terms of Service at any time. Your continued use of my website or services follows any changes requires acceptance of the new terms.
